The Family and Medical Leave Act (FMLA) permits eligible employees to take as many as 12 weeks of leave from a paid position. The leave is unpaid and capped at one 12-week period per year. During this time, the employer must keep open the workers position, so the returning employee may continue on the track to seniority.
